THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION NO.4229 OF 2015 ORDER:

Heard learned counsel for petitioner, Mr. K.Raghavacharyulu, learned counsel appearing for NMDC Limited (1st respondent) and also counsel representing learned counsel for the 3rd respondent.

2. The present writ petition is filed questioning the notice, dated 10.02.2015 issued by the 1st respondent to the petitioner to show cause as to why its contract should not be terminated.

3. The petitioner had replied to the said notice on 19.02.2015 and also questioned the said notice in this writ petition.

4. However, it is not in dispute before this Court that subsequently, the petitioner herein sent a fresh proposal by a letter on 23.04.2015, which has since been accepted by the 1st respondent under proceedings dated 02.06.2015, whereunder issue relating to termination of the petitioner's contract has been resolved by making alternative arrangements was accepted by the 1st respondent. In view of the said subsequent event, the cause in the writ petition does not survive. Hence, a request is made by the learned counsel for the petitioner to dispose of the writ petition on that ground.

5. Accordingly, the writ petition shall stand dismissed in view of the letter, dated 02.06.2015 of the 1st respondent referred to above as impugned show cause notice itself does not survive. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
