THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY WRIT PETITION No.18629 OF 2014 ORDER:

This writ petition is filed to issue a direction declaring the action of the respondents in not granting sufficient time for petitioner's explanation to the charge memo dated 16.06.2014 as illegal, arbitrary and to set aside the same.

The petition is filed on the ground that no sufficient opportunity was afforded to the petitioner to submit his explanation and denial of such reasonable opportunity is violation of principles of natural justice and prayed to set aside the same.

Whereas the learned counsel for the respondents filed counter denying the same.

However, during hearing, learned counsel for the petitioner brought to the notice of this court that the enquiry was completed and a report was submitted to the disciplinary authority and aggrieved by the same, the petitioner preferred another writ petition, wherein he obtained an interim direction against the respondent-employer. Therefore, the cause in the writ petition has become infructuous in view of completion of enquiry.

Accordingly, the writ petition is dismissed as infructuous. No costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
