HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.16484 of 2003 ORDER:

This writ petition is filed to declare the action of respondents in not regularizing the period of suspension from 31.12.1984 to 30.11.1991 and in denying the increments for the said period and in not fixing the pay scale of petitioner considering his service as illegal, arbitrary and violative of Articles 14 and 21 of Constitution of India.

2. As seen from the record, petitioner herein earlier filed W.P.No.13724 of 1995 and pursuance of the direction issued in the said writ petition, representations of petitioner dated 02.08.2001, 30.06.2002 and 08.05.2003 have been considered and petitioner was informed that he was unauthorizedly absent from 05.12.1984 and again from 07.07.1988, the said period would be treated as not on duty and accordingly pay fixation was made.

3. Petitioner has not shown any interest in prosecuting the case and as seen from the affidavit, he was 50 years old as on the date of filing of this writ petition and by this date, he must have retired from service.

4. Considering these aspects, this writ petition is dismissed for nonprosecution.

5. Miscellaneous petitions pending, if any, shall stand closed. No costs.
