CRIMINAL PETITION NO. 15723 OF 2016 O R D E R :
This Criminal Petition is filed by the petitioner/A1 under section 438 Cr.P.C. seeking to enlarge him on bail in the event of his arrest in Crime No. 32 of 2016 of Nandigam Police Station, Srikakulam district, registered for the offences punishable under section 417, 420, 376 and 109 of IPC.
2. Heard the learned counsel for the petitioner/A-1 and the learned Additional Public Prosecutor appearing on behalf of the State.
3. The allegation against the petitioner is that on promising to marry the defacto complainant, who is a minor, he had sexual relationship with her, due to which she gave birth to a female child and when she asked to marry her, he refused to marry her.
4. As seen from the record, earlier the petitioner/A-1 already moved two anticipatory bail applications; namely, Crl.P.No. 8254 of
2016 and Crl.P.No. 9525 of 2016 and the same were dismissed by this Court, vide orders dated 20/6/2016 and 12/7/2016 respectively.
4. There is no substantial change in the circumstances, the present anticipatory bail application is not maintainable and the same is accordingly dismissed.
5. As a sequel, miscellaneous petitions if any pending in this Criminal Petition shall stand disposed of.
