The Hon'ble Sri Justice C.V.Nagarjuna Reddy Civil Revision Petition No.2657 of 2018 Date: 27.04.2018 Between:

Nadella Raghuram .. Petitioner and Grandhi Adinarayana Gupta and another .. Respondents Counsel for the Petitioner :

Mr.Chetluru Sreenivas The Court made the following:

Order :

This Civil Revision Petition is filed against Order, dated 02-04-2018, in IA.No.673 of 2018 in OS.No.1591 of 2014 on the file of the Principal Senior Civil Judge at Visakhapatnam.

The petitioner is the tenant of respondent No.1. Respondent No.1 filed the aforementioned suit for eviction. One of the grounds for eviction is that the petitioner has sublet the suit schedule premises to respondent No.2/defendant No.2 by violating the terms of the lease agreement. The petitioner has filed the aforementioned IA for condoning the delay in filing a document annexed thereto in order to establish that he has not sublet the suit schedule premises to respondent No.2. This Application has been dismissed by the lower Court on the ground that the proposed document has no relevance whatsoever in adjudication of the issues arising in the suit. Mr.Chetluru Srinivas, learned Counsel for the petitioner, submitted that the proposed document is the

Retail License Certificate issued by the licensor to the petitioner.

As rightly observed by the lower Court, the Retail License Certificate of the petitioner has no relevance for the purpose of adjudicating whether he has sublet the suit schedule premises to respondent No.2 or not. The lower Court has rightly held that the proposed document is extraneous to the issues involved in the suit and that the same is not relevant for the purpose of its adjudication. For the aforementioned reasons, the Civil Revision Petition is dismissed.

As a sequel to dismissal of the Civil Revision Petition, IA.No.1 of 2018, filed by the petitioner for interim relief, is disposed of as infructuous.
