HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14453 OF 2018 ORDER :

This Writ Petition is filed challenging the proceedings issued in Rc.No.A2/20/Social Audit/DWMA/2015, dated 10.11.2017 by the 2nd respondent wherein and whereby the appeal filed by the petitioner against his termination order passed by the 3rd respondent vide proceedings dated 15.02.2017 was dismissed. Heard learned counsel for the petitioner and Sri M.S.R.Chandra Murthy, learned Standing Counsel for the respondents 2 and 3.

Learned counsel for the petitioner submits that without any application of mind the impugned order dated 10.11.2017 is passed by the 2nd respondent without assigning any reasons, which is in violation of principles of natural justice. A perusal of the impugned proceedings dated 10.11.2017 passed by the 2nd respondent goes to show that there is no application of mind and no plausible reasons are assigned in the said order except referring to proceedings of original authority. In view of above facts and circumstances, the impugned order dated 10.11.2017 passed by the 2nd respondent is set aside and the appellate authority is directed to reconsider the contentions raised by the petitioner after affording an opportunity of hearing to the petitioner and pass orders in accordance with law.

Accordingly, this Writ Petition is allowed to the extent indicated above. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
