HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43926 of 2016 ORDER:

This writ petition is filed seeking to call for records in Crime No.1165 of 2016 and to quash the same.

Heard and perused the material available on record. The main grievance of the petitioner is that the 3rd respondent lodged the present complaint alleging that on 30.09.2016 at about 15.00 hours, the daughter of the 3rd respondent Doradla Sai Madhuvika left the house of grandfather at Bandlaguda, Nagole, without informing to anyone and did not return and that her whereabouts are not known and that the 3rd respondent suspected that the petitioner has kidnapped her daughter.

Learned counsel for the petitioner contended that the daughter of the 3rd respondent and the petitioner, who are close relatives, fell in love with each other, but due to family disputes between the two families, they have not agreed for their marriage and that when the parents of the petitioner went to the house of the 3rd respondent, the 3rd respondent and her family members beat the victim girl indiscriminately and caused injuries and abused in vulgar language and they have thrown her from the house by saying that they have no daughter and that on 01.10.2016, when the victim girl tried to call the 3rd respondent, she could not get any response and that she came along with the petitioner and to protect themselves, they left Hyderabad. Admittedly, it is evident from the record that the petitioner married the daughter of the 3rd respondent. The photographs and

the certificates are also produced before this Corut and that the alleged victim girl is also major.

Considering the said facts and circumstances, the 2nd respondent is directed to complete the investigation in Crime No.1165 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is directed to execute a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety to the satisfaction of the 2nd respondent as surety for his future appearance for the purpose of investigation. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 16th December, 2016 KL
