SMT JUSTICE T.RAJANI CRIMINAL PETITION No.313 OF 2013 ORDER:
This petition is filed by the petitioners, who are A.1 to A.5 and A.7, seeking to quash the proceedings in Crime No.8 of 2013 on the file of Kanchikacherla Police Station, Krishna District. The offences alleged are under Sections 353, 506 and 34 IPC. 2.
Heard learned counsel for the petitioners and the Public Prosecutor appearing for the 1st respondent. None appears for the 2nd respondent in spite of notice.

A perusal of the complaint shows that though it was alleged that the petitioners herein have obstructed duties of the complainant, the ultimate prayer is made only for providing protection for carrying on his duty smoothly. The complainant, who was an Election Officer on 15.01.2013, was performing his duties in respect of the elections of the cooperative society. Then the petitioners came there and questioned the complainant about the registration of the voters and also gave some complaint to him in that regard and threatened that they would confine him. Being afraid of those threats, he gave a report seeking for protection. 4.
Hence, in view of the above, this court opines that continuation of further proceedings against these petitioners would be an abuse of process of law.

With the above observations, the Criminal Petition is allowed and the proceedings in Crime No.8 of 2013 on the file of
Kanchikacherla Police Station, Krishna District, are hereby quashed against the petitioners/A.1 to A.5 and A.7. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
