Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage. 2.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondent No.3 in not completing investigation in connection with Crime No.72 of 2016 of II Town Police Station, Narasaraopet, Guntur District, for the offences punishable under Sections 420, 323 and 509 of IPC and not recording the statements from the petitioner and his witnesses, as illegal and arbitrary.

At the time when the matter is taken up for hearing, learned Government Pleader for Home states that the SDPO secured permission from the higher authorities to refer the case as civil in nature and as such nothing survives for adjudication in the writ petition. 4.

Learned counsel for the petitioner would submit that till date, no such referred notice was given to the petitioner and in case a final report is filed for the offences mentioned above, the petitioner may be given an opportunity to avail the remedies available under law. 5.

Recording the statements made across the Bar, the writ petition is disposed of directing the respondents, to serve a notice on the informant before filing the final report, in accordance with law, in which event, the petitioner is always at liberty to take steps, in accordance with law. No costs.
