THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CIVIL REVISION PETITION No.1950 OF 2019 ORDER:

This Civil Revision Petition is filed by the petitioner/Decree Holder, under Article 227 of the Constitution of India, aggrieved by the docket order dated 01.05.2018 passed in E.A.No.205 of 2018 in E.P.No.36 of 2018 by the III Junior Civil Judge, City Civil Court, Hyderabad.

2) Heard the learned counsel for the petitioner and perused the record.

3) The main contention put-forth before this Court is that E.A.No.205 of 2018 filed in E.P.No.36 of 2018 pending before the Court below is not maintainable. It is also stated that a memo is filed stating that the said E.A. is not maintainable but the same is not yet determined by the Court below.

4) Under these circumstances, the Court below is directed to decide the maintainability of E.A.No.205 of 2018 pending on its file, preferably within a period of thirty (30) days from the date of receipt of a copy of this order.

5) With the above direction, this Civil Revision Petition is disposed of at the admission stage.

Miscellaneous Petitions, if any, pending in this revision shall stand closed.
