THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.36887 of 2015 ORDER:

The grievance of the petitioner was that the police authorities were not registering a crime upon his complaint despite the same being sent to them by registered post.

Learned Assistant Government Pleader for Home, relying on the written instructions dated 18.11.2015 received from the Station House Officer, Matur Police Station, Prakasam District, informed this Court that a photocopy of the petitioner's complaint was received by registered post, whereupon the police authorities asked the petitioner to produce the complaint copy with the original signature so that they could register a case. According to the police authorities, the petitioner failed to do so and filed this writ petition.

In that view of the matter, the writ petition is closed permitting the petitioner to place before the police authorities concerned the original of his complaint with his signature or in the alternative a fresh complaint in original. Thereupon, in accordance with the law laid down by the Supreme Court, speaking through a Constitution Bench, in LALITA KUMARI V/s. GOVERNMENT OF UTTAR PRADESH, the police authorities would be bound to take action as specified therein.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
