THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE MRS. JUSTICE ANIS WRIT PETITION No. 22086 OF 2015 O R D E R: (per Hon'ble Sri Justice Nooty Ramamohana Rao) The petitioner appears to have moved the Andhra Pradesh Administrative Tribunal by instituting O.A. No. 2196 of 2015 some time in the 1st week of April 2015. The Tribunal, it appears, entertaining the O.A., issued notice to the respondents and the respondents are yet to file their reply in the O.A. However, this Writ Petition is moved on the premises that the interim relief sought for has not been granted. Though the relief sought for is innocuous, but however, the catch lies in the phraseology used in the interim relief portion of the O.A.

The petitioner prayed for consideration of his case for promotion as Mandal Parishad Development Officer (MPDO) and also to assign him notional promotion as MPDO with effect from 31.12.2014. That, perhaps, has triggered some reaction from the Court. The Court wanted to know, obviously, as to why the case of the petitioner has not been considered for promotion with effect from 31.12.2014, while cases of similarly-placed persons have been considered for such promotion by the respondents.

Therefore, we do not find any infirmity, in principle, in the Administrative Tribunal issuing notice to the respondents and inviting their response to the claim of the petitioner.

The Writ Petition is therefore, dismissed at the admission stage. No costs.

However, since the issue appears to be lying in a very narrow compass and the statute by which the Andhra Pradesh Administrative Tribunal has been constituted desires every application to be decided in six months' time, we hope and trust that the Tribunal will live up to this expectation of the statute.

Consequently, the miscellaneous applications, if any shall stand dismissed.
