This Criminal Petition is filed seeking the Court to enlarge the petitioner on bail, who are arrayed as accused No.1 in Criminal Appeal No.474 of 2018. The petitioner was apprehended in execution of a Non-Bailable Warrant issued by the II Additional Sessions Judge, Hyderabad, on 18.04.2026 and was produced before the appellate Court on
the same day, whereupon he was remanded to judicial custody and has been in custody since then.

Heard Sri Syed Osman, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for Respondent -State. 3.
Learned counsel for the petitioner submitted that the petitioner was apprehended in execution of a Non-Bailable Warrant on 18.04.2026 and has been in custody since then and that the petitioner was marked absent on 03.01.2024 as he was out of station attending to his aged and ailing mother, who was suffering from kidney-related ailments and was undergoing treatment at Gulbarga and that from 2018 till 2024, the petitioner had been regularly attending the Court proceedings, and his absence on the said date was neither intentional nor deliberate. He further contended that the petitioner is ready to attend the Court on every date of hearing hereafter and to cooperate with the proceedings. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned
counsel for the petitioner, contending that the petitioner is involved in multiple cases registered at different police stations, namely CC No.11795/2025, CC No.6827/2025, CC No.06/2026, Crime No.325 of 2014 of PS Humayun Nagar, Crime No.314/2020 of PS Kottur, and Crime No.190 of 2025 of PS Bahadurpura and that due to the non-appearance of the petitioner before the appellate Court, the proceedings were stalled, and a Non-Bailable Warrant was issued against him on 03.01.2024. Since then, the petitioner was absconding until his apprehension. He further submitted that in the event of release on bail, there is every likelihood that the petitioner may again abscond or evade the process of law, which would adversely affect the progress of the case. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is evident that the petitioner was produced before the appellate Court on 18.04.2026 in execution of the NonBailable Warrant and has been in judicial custody since then. Considering the overall facts and circumstances of the case, the stage of investigation and the duration of incarceration,
this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned II Additional Sessions Judge, at Nampally, Hyderabad.
ii.
The petitioner shall appear before the appellate Court on every date of hearing and shall to cooperate with the proceedings.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
