THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.7646 OF 2015 ORDER:

The petitioners were appointed as Fair Price Shop dealers of Shop Nos. 19 and 20 respectively at Karimadela village, Gadivemula Mandal, Kurnool District. The 4th respondent by bifurcating the existing fair price shops of the petitioners, created a new shop. Challenging the same, the present writ petition is filed.

2. A counter affidavit is filed stating that a new shop is being created in the same village taking out 187 cards from Shop No.19 and 215 cards from Shop No.20 and even after taking out of the cards from those shops also, the petitioners have 451 cards in Shop No.19, where as in Shop No.20, it is 427 cards. A new shop is being created as per the orders of the Joint Collector and there is no violation of G.O.Ms.No.35, dated 17-09-2007.

3. In view of number of cards existing as indicated above and disclosed in the counter affidavit filed by the respondents, this Court see no reason to interfere with the decision of the authority in creating a new shop in the village for better distribution of the essential commodities to the cardholders. The writ petition is devoid of merits and is liable to be dismissed.

4. Accordingly, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
