THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27135 of 2014 ORDER:

This Writ Petition was filed challenging the action of respondents in suspending the petitioner from service by proceedings dated 09.12.2013.

A counter affidavit was filed stating that the Zonal Officer of respondents conducted a Micro Level Academic Review Conclave on 04.12.2013 at Srikrishnapuram and during the review certain lapses were noticed against the petitioner, who is working as TGT (English), Duppalavalasa, Srikakulam District. It was noticed that he was exhibiting reckless attitude, which was violative of Rule 2

(2) and (3) of the Conduct Rules applicable to the employees of the Society. Accordingly, he was placed under suspension by proceedings dated 09.12.2013. When he requested for reinstatement, he was reinstated into duties and posted to Kanchili, Srikakulam District, pending enquiry and without prejudice to the disciplinary proceedings vide proceedings dated 07.01.2014. The article of charges was issued to the petitioner on 24.01.2014 and he submitted his statement of defence. Since the Zonal Officer was not convinced with the same, the Inquiry Officer was appointed.

In view of the above facts, this Writ Petition has become infructuous as the petitioner was reinstated into service, pursuant to his request made.

Accordingly, this Writ Petition is dismissed as infructuous. No order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
