HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.86 of 2014 ORDER :
This petition is filed to withdraw marriage O.P.No.14 of 2010 from the file of Senior Civil Judge, Sompeta, and transfer the same to Family Court, Visakhapatnam.
2. Wife is petitioner and she filed her affidavit. According to which, her marriage with respondent was performed on 12.05.2005 at Visakhapatnam and they lived happily for some time at S.I.G.Nagar, Old Dairy Farm, Visakhapatnam and they were blessed with two children and thereafter due to harassment, she lodged a complaint with police and due to counseling of the police respondent agreed and promised to take care of her, but he breached his promise. She further stated that she filed M.C. before Family Court, Visakhapatnam, and the same was disposed of on 27.08.2012 and to harass her, husband intentionally filed O.P. for restitution of conjugal rights before Sompeta Court, Srikakulam, and that respondent is resident of S.I.G.Nagar, Old Dairy Farm, Visakhapatnam. She further stated that she has to look after the children, who are at Visakhapatnam, and it is difficult for her to attend Sompeta for defending this O.P., for these reasons she prayed transfer of marriage O.P. from Sompeta to Visakhapatnam.
3. Respondent in spite of service of notice neither
appeared in person nor through any Advocate.

5. Considering the reasons stated in the affidavit and also considering the convenience of wife, marriage O.P.No.14 of 2010 is withdrawn from Senior Civil Judge, Sompeta, and transferred to Family Court, Visakhapatnam, for disposal in accordance with law.
6. Accordingly, transfer C.M.P. is allowed. No costs.
