THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.13179 of 2015 ORDER:
The grievance of the petitioner was that the police authorities were not taking action pursuant to his complaints dated 13.04.2015 and 04.04.2015. By the said complaints, the petitioner sought action to be taken against a private party, the 5th respondent herein, who was alleged to have taken away material in violation of prohibitory and injunctive orders. A counter-affidavit was filed by the Superintendent of Police, SPSR Nellore District, wherein he stated that the petitioner's complaints dated 13.04.2015 and 04.04.2015 were considered and rejected. A copy of the proceedings embodying such rejection was also placed on record. Perusal thereof reflects that a copy was to be communicated to the petitioner with acknowledgment. As this aspect of the matter was disputed, the learned Assistant Government Pleader for Home was asked to clarify.
Today, the learned Assistant Government Pleader for Home produced another copy of the said proceedings bearing the endorsement of receipt by the petitioner with his signature and date as 19.05.2015. In the light of the aforestated development, the grievance of the petitioner as regards the alleged inaction on the part of the police authorities stands settled. In the event he is aggrieved by the proceedings rejecting his complaint, he necessarily has to challenge the same in accordance with law. Reserving liberty to the petitioner to do so, the writ petition is dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
