HON'BLE SRI JUSTICE S.V.BHATT WPMP Nos.54453 OF 2015, 48988 OF 2016 AND W.P.No.14944 OF 2003 COMMON ORDER:
The WPMPs are filed for the following reliefs: WPMP No.54453 of 2015:
"...to set aside the order dated. 25-11-2015 passed in W.P. No. 14944 of 2003 and restore the same to file..." WPMP No.48988 of 2016:
"...to set aside the dismissal order dt.19.10.2010 against Respondent No.1 and extend the time for service of notice on the Respondent No.1 in W.P.No.14944 of 2003..."
The reasons stated in support of the above prayers are that the standing counsel was changed and the same was not noticed by the newly appointed standing counsel. The writ petition against respondent No.1 was dismissed on 19.10.2010. The petitions are filed on 21.12.2015 and 01.11.2016. The change of standing counsel is known to the petitioners herein as well the counsel who has been appointed in the place of the standing counsel then representing the Corporation. If the petitioners or the Corporation fail to take prompt or timely steps, the name of counsel who appeared for petitioners would continue to be shown in the cause list. The Corporation ought to have changed the vakalat of standing counsel and filed the Vakalat within time. Further the lis is confined to the direction issued by the Labour Court for refund of Rs.500/ - to workman. I am satisfied that the cause shown is insufficient,
inadequate and untenable for allowing the prayers. For the above reasons, these two petitions fail and accordingly dismissed. In view of the dismissal of the writ petition against respondent No.1 vide order dated 19.10.2010, the writ petition fails and accordingly dismissed.
