R.Srimathamma v. The Director, Women And Child Welfare Department
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.7976 OF 2007 Dated:24.02.2020 Between:
R. Srimathamma, W/o. Srisailam .. Petitioner And The Director, Women & Child Welfare Department, Government of Andhra Pradesh, Secretariat, Hyderabad and others .. Respondents This Court made the following:
- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.7976 OF 2007 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Women Development and Child Welfare for the respondents.
2.
This writ petition is filed by the petitioner, who is working as Anganwadi Worker of Sherupalli Anganwadi Center, alleging that she is not allowed to joint duty.
3.
In the counter affidavit filed by the Development Officer, the 3rd respondent, it is stated that the petitioner was not attending to duties regularly since the year 2003 and vexed with her irregular attendance and long absence, she was removed from service and in her place, Smt. K. Sunitha was appointed as Anganwadi Worker. 4.
Though counter affidavit was filed on 06.09.2007, no steps were taken to implead the subsequent appointed candidate. Assuming that not allowing the petitioner to join duty is grave lapse on the part of the respondents, but as the order of removal from service and the appointment of another person are not under challenge in this writ petition, no relief as prayed for by the petitioner can be granted.
5.
The writ petition is accordingly dismissed. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed.
