THE COURT MADE THE FOLLOWING:

ORDER:

The petitioners feel aggrieved by the inaction of respondent Nos.3 to 7 in redressing their grievance, namely, to properly refill the cavity developed on account of laying of a pipeline for drinking water from Manair Dam to Shanigaram, through the petitioners' land.

A perusal of the record shows that the petitioners have submitted a representation on 01.11.2014 to respondent No.3 wherein they have informed that due to non-filling

of the cavity developed on account of laying of pipeline, they could not grow the crops during monsoon season of 2013, summer and monsoon seasons of 20142015, and that they are unable to raise the crop for 2015 summer also. The petitioners pleaded that despite their representation, respondent No.3 has not taken any action.

If the facts pleaded by the petitioners are correct, there is an urgent need for respondent No.3 to alleviate the rightful grievances of the petitioners. The petitioners cannot be deprived of the benefit of land use with improper filling of trenches excavated for laying the drinking water pipeline. Therefore, respondent No.3 is directed to forthwith consider the grievances of the petitioners after notice to them, hold a personal enquiry, redress their grievances and communicate the same to them within one month from the date of receipt of this order.

Subject to the above directions, the writ petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P. No.13032 of 2015. _______________________ C.V. NAGARJUNA REDDY, J 19-11-2015 bnr
