THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.946 of 2017 ORDER:

This petition, under Section 438 Cr.P.C., is filed by the petitioner/A.2 to grant anticipatory bail in the event of his arrest in connection with Crime No.130 of 2016 of Nallakunta Police Station, Hyderabad City, registered for the offences punishable under Sections 420 and 379 IPC.

After arguing for some time, learned counsel for the petitioner Sri A.Prabhakar Rao, requested the Court to permit the petitioner to surrender before the III Additional Metropolitan Sessions Judge, Hyderabad and file an application for grant of bail. 3.

Acceding to the request of learned counsel for the petitioner, without touching the merits of the case, I deem it appropriate to permit the petitioner to surrender himself before the Court below and move an application for grant bail, in which event, the learned Magistrate is directed to consider the application on the same day after serving advance notice to the Public Prosecutor. 4.

With the above direction, the criminal petition is disposed. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
