HON'BLE SRI JUSTICE SURESH KUMAR KAIT Criminal Petition No.16075 of 2016 ORDER:
Vide present petition, the petitioner/ A.1 seeks anticipatory bail in Cr.No.49 of 2015 of PS Gundala, Nalgonda District (now Jangoan District), registered for the offences under Sections 143, 448, 427, 436 and 353 of IPC. The case of the prosecution against the petitioner is that on 17.06.2015 one T.Maisaiah, HC 1870, PS Gundala along with two police constables, went to Theryala Village for 'bando bastu' for the incident of dowry death of Vemula Swapna W/ o Srikanth, whose body after post-mortem and inquest, was brought to the village and kept in the house of her in-laws, Yadagiri. On 18.11.2015 at about 4 a.m., the deceased Swapna's related villagers Srisailam, Cheguveera Youth Members and relatives were became as unlawful assembly and demanded for an amount of Rs.6,50,000/ - as compensation. Accordingly, entered into the house of Yadagiri and damaged the doors and set fire and obstructed the duties of the police officers.
Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
Taking into consideration of the gravity of the offences alleged against the petitioner, I find no grounds to allow the present petition, as the custodial interrogation of the petitioner, in the present case, is very much required.
