THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 6418 OF 2013 ORDER:

This Writ Petition is filed to declare local publication made in extraordinary gazette dated 18-02-2013 by respondent No. 3 as illegal and arbitrary and consequently to direct the respondents to continue the lease period of the petitioners in the subject shops for a further period of three years. 2.

As seen from the counter affidavit, the petitioners submitted representations requesting for renewal of lease for a further period of three years from 01-10-2011 and the said request was placed before standing committee and the standing committee rejected the same. Accordingly, notice was served on the petitioners on 30-12-2011 to vacate the subject shops. Challenging the said notice asking the petitioners to vacate the subject shops, the petitioners filed W.P.No. 13308 of 2012 and an interim direction was passed in the said Writ Petition while observing that it is open to the petitioners to participate in the auction and in case they emerge as the highest bidders or if they agree to pay the amount that is fetched as the highest bid, they shall be entitled to be granted fresh lease.

When the matter came up for admission on 05-03-2013, learned standing counsel for respondent No. 3-corporation submitted that pursuant to the interim direction in W.P.No. 13308 of 2012, auction was already conducted.

In view of the said submission made by learned standing counsel, no further orders are necessary in the Writ Petition. 5.

The Writ Petition is accordingly closed. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
