THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4775 OF 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/Accused No.1 for grant of anticipatory bail in the event of her arrest in connection with Crime No.153 of 2019 of Rajendranagar Police Station, Ranga Reddy District, registered for the offence punishable under Section 420 I.P.C. 2.

Heard learned counsel for the petitioner/Accused No.1 and the learned Additional Public Prosecutor representing the respondent/State. Perused the record.

Learned counsel for the petitioner would submit that no specific overt act is attributed against the petitioner; that all the allegations levelled against the petitioner are false; that accused No.2, who is husband of the petitioner, was arrested on 24.03.2019 and subsequently, released on bail and hence, he prays to grant bail to the petitioner.

Learned Additional Public Prosecutor opposed the grant of the bail to the petitioner/accused.

As seen from the contents of the First Information Report, there is specific allegation against the petitioner that she along with other accused collected an amount of Rs.22,00,000/- from 14 members on the premises of procuring nursing jobs in Bumrangd International Hospital, Bangkok, but postponed traveling and visa for five times from October, 2015 and after

enquiry came to know that they have been deceived in the name of securing employment.

There are specific instances as to how the victims were deceived in the hand of the accused. Thus, looking into the nature of allegations and the gravity of offence, I am not inclined to grant bail to the petitioner. Hence, the criminal petition is liable to be dismissed.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
