HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14434 OF 2018 O R D E R :

This petition is filed for a writ of Mandamus declaring the proceedings in Rc.No.90/PS-I/2010-3, dated 20.07.2017 of the 2nd respondent as arbitrary, illegal and contrary to Rule 12 of G.O.Ms.No.1 (Edn) dated 01.01.1994 and G.O.Ms.No.40, School Education (PS) Department dated 30.06.2017 and consequently direct the respondents 3 and 4 to process the proposals of the petitioner management dated 07.09.2017 for filling up of the 3 vacant aided posts in the petitioner institution and accord permission in terms of the provisions of G.O.Ms.No.1 (Edn) dated 01.01.1994.

Heard learned counsel for the petitioner who submits that in similar circumstances this Court passed orders in WP.MP.No.33948 of 2017 in WP.No.27320 of 2017, dated 17.08.2017, and that the present writ petition can also be disposed of in terms of the said order.

The same is not disputed by learned Assistant Government Pleader for School Education.

In view of the above, without expressing any opinion on merits, the writ petition is disposed of directing the competent authority to consider the proposals submitted by the petitioner in accordance with Rule 12 of the G.O.Ms.No.1, Education (PS-2)

Department, dated 01.01.1994, and take action accordingly. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
