The petitioners pray for the following relief: "...this Hon'ble Court may be pleased to issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in acquiring the lands bearing Sy.No.568/11A, admeasuring Ac.2.00 and Sy.No.
593/11B admeasuring Ac.2.00 situated at Kattamuru Village, Peddapuram Mandal, East Godavari, through Draft Notification in proceedings No.G2/2246/2008 dated 21.04.2008 published in Eenadu Newspaper 29.04.2008 and Draft Declaration dated 16.08.2008 published in Vishalandra Daily on 19.08.2008, as illegal, arbitrary and without jurisdiction and set aside the same and pass ....". The Assistant Government Pleader basing on instructions submits that the land is not required for acquisition. The relevant portion of letter dated 05.08.2017 of 2nd respondent reads as follows: "I submit that the land covered by the W.P.No.19893/2008 is under the possession of the land owner and no compensation was paid. We are not proceeding further to acquire this land at the point of time due to changed circumstances.
Fresh land acquisition proceedings will be initiated under the provisions of new land acquisition act if the land is still required to provide the house sites to poor families as and when the instructions received from the Government."
is placed on record.
Having regard to the communication dated 05.08.2017, the writ petition is disposed of by placing on record the letter. There shall no order as to costs.
Consequently, pending miscellaneous petitions, if any, stand closed.
