ORDER:

Feeling aggrieved by the selection and appointment of respondent No.4 as the fair price shop dealer in preference to the petitioner, the latter filed this writ petition.

At the hearing, it has come out that the appeal filed by the petitioner questioning the appointment of respondent No.4 is pending before respondent No.1 and the learned counsel for the petitioner requested for permission of the Court to withdraw the writ petition with liberty to his client to pursue the said appeal. Accordingly, the Writ Petition is dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
