THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION Nos.9645 AND 9646 OF 2017 COMMON ORDER:

Heard the learned counsel for the petitioners/A1 to A3 of Crime No.24 of 2011 of P.S. Tekkali, Srikakulam District and Crime No.24 of 2011 of P.S.Narasannapeta, Srikakulam District, respectively, investigating by CID, registered on the report of the 2nd respondent - defacto complainant and perused the material with the grounds urged in the quash petition and also heard the learned public prosecutor representing the respondents.

The main grievance is even six years lapsed from the date of registration of crime, there is no progress of completion of investigation.

Having regard to the above, instead of going into merits as the investigation is pending, the CID police are directed to complete the investigation and file final report within four months from date of receipt of the order. All defenses of the petitioners are left open including in the event of filing any such final report. If final report is not filed, further remedy if at all, is also left open to go into further merits. 4.

Accordingly and with the above observation, these criminal petitions are disposed of. Miscellaneous petitions pending consideration, if any, in these cases shall stand closed in consequence.
