HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.7002 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and learned Standing Counsel for APSRTC appearing for respondents 1 and 2.

This Writ Petition is filed seeking to declare the action of the respondents in not allowing the petitioner-firm to display the advertisements and not disposing of its representation dated 18.12.2014, as arbitrary and illegal. The case of the petitioner is that the respondentCorporation entered into an agreement with it on 17.5.2010 for displaying advertisements on metro buses and metro deluxe buses, on payment of Rs.1,582/- per month & per bus, on certain terms and conditions mentioned therein, but, the respondent-Corporation is not allowing it to display the advertisements on the buses as per the agreed terms and conditions.

Learned counsel appearing for the petitioner submits that the petitioner setting forth all its grievances made a representation dated 18.12.2014 before the first respondent, but, so far, no orders have been passed thereon.

Learned Standing Counsel appearing for the respondent-Corporation submits that as on date, there is no proposal to call fresh tenders in respect of the subject

matter of the agreement dated 17.05.2010 entered into between the parties. He further submits that the respondent-Corporation has not received any representation from the petitioner.

Under these circumstances, the petitioner is directed to submit a fresh representation within a period of two weeks and on making such representation, before proceeding with the process of fresh tenders, the respondents are directed to consider and dispose of the same in terms of the agreement dated 17.05.2010 entered into between the parties, within a period of four weeks thereafter. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
