THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.28961 of 2017 ORDER:

Heard learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing counsel for respondent Nos.2 and 3.

The respondent Municipal Corporation issued notice bearing No.55/UC/W.No.120/CIR-14B/WZ/GHMC/17, dated 10.04.2017, under Sections 452(1) and 461(1) of the Hyderabad Municipal Corporation Act, 1955, calling upon the petitioner to submit reply while indicating the alleged unauthorized constructions. In response to the said notice, the petitioner submitted his explanation on 09.06.2017 along with relevant documents in support of his title to the property.

When the matter is called, it is submitted by the learned Standing counsel for the respondent Municipal Corporation, on instructions, that the Corporation will consider the petitioner's explanation and take action in accordance with law and that it will not interfere with the possession and enjoyment of the petitioner pending consideration of the explanation.

Recording the said submissions, the writ petition is disposed of, directing the respondent Municipal Corporation to consider the explanation, dated 09.06.2017, and the documents enclosed therewith and pass appropriate orders,

after giving opportunity of hearing to the petitioner. Till then, no coercive action pursuant to the impugned notice shall be taken. It is also made clear that no further construction shall be undertaken by the petitioner. No order as to costs. Miscellaneous petitions, if any, shall also stand disposed of.
