THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.26557 OF 2007 ORDER:
It is the case of the petitioner that he is in possession and enjoyment of the land to an extent of Ac.2.08 cents in Sy.No.186/E in Masaipet Village, Veldurthi Mandal, Medak District. He made an application to the District Collector on 06.08.2007 and 04.12.2007 for issuance of pattadar pass books and title deeds in respect of the said land, the same have been endorsed by the RDO - 2nd respondent directing the Tahasildar - 3rd respondent to consider the representation of petitioner, but no action has been taken up, hence the writ petition is filed.
The respondents filed counter affidavit.
Heard the learned counsel for the petitioner and Sri Harish Kumar, learned Assistant Government Pleader for Revenue (TG). In the counter affidavit, the 3rd respondent submits that the subject lands were assigned lands and the respondents were also sent notices to the petitioner and assignee, but none submitted their explanation, thereafter resumption orders were passed on 10.08.2009 in favour of the Government and incorporated in the pahani as Government land (Khariz Khatha).
It is not stated in the counter affidavit as to the date and the manner in which the land was resumed in favour of the Government. However the said action is not under challenge and the disputed question of fact cannot be gone into. Hence, the Tahasildar, Yeldurthy Mandal, Medak District, third respondent is directed to dispose of the representations dated
WP_26557_2007 TA, J - 2 - 06.08.2007 and 04.12.2007 given by the petitioner, within a period of two months, in accordance with law.
Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
