CVNR, J & MSKJ, J WP 21085/2017 ORDER: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus directing respondent Nos.2 to 5 to produce the petitioner's husband Mr. Perla Eswar Rao, S/o. Late Abbai, before the Court and set him at liberty. On behalf of respondent Nos.3 to 5, respondent No.5, SubInspector of Police, Central Crime Station, Vijayawada, Krishna District, filed a counter affidavit wherein it is stated that the alleged detenu was arraigned as accused No.2 in Crime No.366 of 2017 registered for the offences punishable under Sections 457, 380 and 411 IPC, in Penamaluru Police Station, Vijayawada, that he was arrested on 28.06.2017 along with accused No.1 - Bhupati Jaya Raju and produced before the I Metropolitan Magistrate, Vijayawada, on 29.06.

2017, who remanded the alleged detenu to judicial custody and that in pursuance of the said remand order, he is presently lodged in District Jail Vijayawada. In view of these subsequent events, the writ petition is disposed of as infructuous, however, with liberty to the alleged detenu to institute appropriate legal proceedings against the State for his alleged illegal detention, as submitted by the learned counsel appearing for him at the hearing. __________________________ C.V.
