Tadikonda Venkata Nancharaiah, v. The Government Of Andhra Pradesh Rep. By Its Principal
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 10198 of 2015 ORDER:
Questioning the inaction of respondents 2 to 4 in handing over the possession of agricultural land over an extent of Ac.2-54 cents of land in Survey Nos.228/12 and 153/3 of Chinnapuram village, Bandar mandal, Krishna district, this writ petition is filed.
2. The petitioner asserts that his father was issued D-Form patta in the year 1970 assigning the subject land and his father's name was entered in the revenue records as 'pattadar' of the said land, which is evident from the certificate issued through Mee Seva on 31.05.2013, and due to the demise of his father, the subject land rightfully belongs to him.
3. Heard both the counsels and perused the record.
4. Learned counsel for the petitioner submits that respondents 5 and 6 have illegally occupied the land allotted to the father of the petitioner and he, being a person belonging to Scheduled Caste, is unable to enjoy the benefits of the assignment on account of the acts of the respondents 5 and 6. Bringing all these aspects to the notice of the respondent authorities, the petitioner is said to have made a representation to the District Collector on 27.07.2014 and also made a complaint before A.P. Lokayukta. Once again a representation was made on 29.09.2014 to the District Collector in 'Prajavani' requesting to issue passbooks in his favour. Though Sub-Inspector of Police came to the village and enquired, thereafter the petitioner had not received any communication. His further enquiries in the Collectorate only resulted in being informed as 'grievance settled' in the status report. However, till today, no communication is received by the petitioner.
5. Considering the nature of allegation made by the petitioner, there shall be a direction to the 2nd respondent to consider the representations of the petitioner dated 27.07.2014 and 29.09.2014 and take necessary action, within a period of four months from today, in accordance with law, so as to enable the petitioner to enjoy the benefit of assignment alleged to have been granted in favour of his father.
6. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed. ____________________________ CHALLA KODANDA RAM, J 10th April, 2015 KSM
