HON'BLE SRI JUSTICE R.KANTHA RAO C.R.P.No.1320 OF 2016

ORDER

Heard learned counsel appearing for the revision petitioner.

This Civil Revision Petition is directed under Article 227 of the Constitution of India seeking a direction to the Court below for early disposal of E.A.No.155 of 2016 in E.P.No.6 of 2009 in O.S.No.326 of 2004.

Having regard to the nature of relief sought for, this Court is of the opinion that notice to the opposite party is not necessary.

The petitioner filed E.A.No.155 of 2016 to raise the attachment and to grant injunction. Though the said EA was filed about a year ago, it seems that the learned Executing Court has posted the matter for counter and is not evincing any interest to dispose of the same.

Learned counsel appearing for the petitioner submits that lot of prejudice has been caused to the petitioner on account of the inordinate delay in disposing of E.A.No.155 of 2015.

Having regard to the said submission, the Civil Revision petition is disposed of at the admission stage directing the Court below to dispose of E.A.No.155 of 2015 in E.P.No.6 of 2009 in O.S.No.326 of 2004 within a period of thirty (30) days from the date

of receipt of a copy of this order.

Miscellaneous petitions, if any, pending shall stand closed.
