THE HON'BLE SRI JUSTICE P. NAVEEN RAO ORDER:
According to the petitioner, he is the owner and is in possession of land to an extent of Ac.1-99 cents in Survey No.53/2 of Venkatapuram Village, Nimarru Mandal, West Godavari District. Requesting to reflect the entire extent in the online revenue records and alleging that the neighbouring farmer encroached into his land, petitioner made an application/requisition in the "Mee Kosam" redressal forum. The same was forwarded to the Tahsildar for consideration. On consideration of the relevant records, the Tahsildar found that the petitioner is entitled to only Ac.1-91 cents of land but not Ac.1-99 cents, as claimed. According to the Tahsildar, the petitioner owns land in R.S.No.53/2B to an extent of Ac.1-69 cents and in R.S.No.53/2C to an extent of Ac.0-22 cents.
2. Learned counsel for the petitioner submits that this decision of the Tahsildar in the form of endorsement is erroneous and that the petitioner is entitled to reflection of full extent of Ac.1-99 cents in the online records.
3. If what is contended by the petitioner is true, it is the question to be verified. Against the decision of the Tahsildar, an immediate appeal is available under A.P. Rights in Land and Pattadar Pass Books Act, 1971. Without availing such a remedy, the Writ petition is filed. This Court is not inclined to entertain the Writ Petition when the petitioner has an effective and efficacious
remedy and it is open to the petitioner to raise all grounds as available to him, including what all urged in this Writ Petition.
4. Thus, leaving it open to the petitioner to avail the remedy of appeal, with liberty to raise all grounds as available to him in law, including the grounds urged in this Writ Petition, the Writ Petition is dismissed.
