HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8071 of 2016 O R D E R:- Heard learned counsel for the petitioner and the Government Pleader for Civil Supplies appearing for the respondents.

This writ petition is filed challenging the action of the respondents in not supplying the essential commodities to the petitioner's Fair Price Shop No.320, Circle-III, Iqbal Gunj, Puranapool, Hyderabad, and also in not permitting the petitioner to distribute the essential commodities to the cardholders.

According to the petitioner, he is dealer of Fair Price Shop No.320, Circle-III, Iqbal Gunj, Puranapool, Hyderabad. While so, basing on a complaint of the Deputy Tahsildar (Enforcement), Circle II & III, Hyderabad, dated 25.02.2016, that the petitioner in collusion with three others is diverting the essential commodities meant for public distribution system to black market, Crime No.37 of 2016 of P.S. Kulsumpura was registered against

them for the offences punishable under Sections 406, 420 r/w 34 IPC and Section 7 of the Essential Commodities Act.

The Deputy Tahsildar (Enforcement) along with his staff raided the premises bearing door No.13-4-545/B, Jiyaguda, conducted panchnama and seized 100 quintals of PDS rice, 2 quintals of wheat and 35 quintals of broken rice. Thereafter, the respondents stopped supply of essential commodities to his fair price shop for distribution to the cardholders, though his authorization is subsisting and there is no order of suspension of his authorization. Questioning the same, the present writ petition is filed.

Having considered the submissions made on behalf of the petitioner and considering the fact that Section 6-A proceedings have been initiated against the petitioner, no useful purpose would be served by keeping the writ petition pending.

In those circumstances, the competent respondent authorities are directed to consider the explanation that may be submitted by the petitioner, complete the enquiry and pass final orders within a period of four weeks from the date of receipt of a

copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs.

In view of the disposal of the main writ petition, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
