Crl.P.No.2546 of 2015 ORDER:

The de-facto complainant and her counsel Sri R.Sreenivasa Rao are present. The accused No.1 and his counsel Sri M.V.Hanumantha Rao are present.

2. Heard both sides.

On the report given by de facto complainant, the Police of Mahaboobnagar Women Police Station, Mahabubnagar registered Crime No.63 of 2012, conducted investigation and laid charge sheet against A1 to A3 in C.C No.534 of 2013 for the offences under Section 498-A and Sections 4 & 6 of Dowry Prohibition Act, 1961.

4. It is informed that the proceedings against A2 and A3 were already quashed by this Court. While so, the accused No.1 and his counsel appeared before this Court and submitted they have amicably resolved their disputes at the intervention of the elders and the de facto complainant and accused No.1 proposed to obtain divorce and in fact the divorce petition O.P No.1190 of 2012 was already filed and pending before the Family Court, Ranga Reddy District and maintenance claim of de facto complainant is also taken care of and accused No.1 agreed to pay Rs.9 lakhs towards her maintenance after disposal of all the cases pending between the parties, and in view of the settlement, the de facto complainant has no objection for quashment of proceedings and therefore the Court may permit the parties to compound the offence and quash the proceedings in CC No.534 of 2013, in the interest of justice.

Having regard to the above submission and in view of the fact that it is a matrimonial issue which is amicably resolved by the parties and no useful purpose will be served even if the parties are driven to trial and following the decision reported in Gian Singh vs. State of Punjab and another (2012) 10 SCC 303) petition is allowed and the proceedings in Crime No.63 of 2012 of PS, Mahabubnagar Women Police Station, are quashed in the light of the memo filed by parties.

6. In the result, the Criminal Petition is allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
