THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.2081 OF 2017 ORDER:

This Criminal Petition under Sections 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to enlarge the petitioner/ A-2 on pre-arrest bail since he is apprehending arrest in connection with Crime No.105 of 2017 of Krishnalanka Police Station, Vijayawada, Krishna District, registered for the offence under Section 379 IPC and Section 3 of Immoral Traffic (Prevention), Act, 1956.

After arguing the matter for a while, the learned counsel for the petitioner requested this Court to permit the petitioner to surrender before the competent Court having jurisdiction of area where the offence is allegedly committed and on such surrender, if any application is filed before the court concerned, after serving notice on the Public Prosecutor, the Presiding Officer may be directed to decide the petition on the same day. Acceding to the request of the learned counsel for the petitioner, without touching any merits of the case, I deem it proper to permit the petitioner to surrender before the competent Court having jurisdiction of area where the offence is allegedly committed and on such surrender, if any application is filed before the court concerned under Sections 437 and 439 of Cr.P.C., after serving notice on the Public Prosecutor, the Presiding Officer is

directed to decide the petition on the same day, in accordance with law.

Accordingly, the criminal petition is disposed of. Consequently, miscellaneous applications pending if any, shall also stand dismissed.
