THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.4766 of 2019 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioners/Accused Nos.4 to 7 seeking to quash the proceedings against them in C.C.No.967 of 2018 on the file of IV Additional Judicial Magistrate of First Class, Warangal.

Heard the learned counsel for the petitioners/Accused Nos.4 to 7, the learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

Though learned counsel for the petitioners filed the petition for quashing the proceedings in the aforesaid Calendar Case, he restricts his prayer seeking dispensation of personal appearance of the petitioners/Accused Nos.4 to 7 before the Court below. 4.

As seen from the charge sheet, the petitioner/accused No.6 is absconding. Therefore, the prayer to dispense with the personal appearance of the petitioner/accused No.6 before the Court below is rejected.

Having regard to the facts and circumstances of the case and considering the request of learned counsel for the petitioners, without expressing any opinion on the merits of the case, the personal appearance of the petitioners/Accused Nos.4, 5 and 7 in C.C.No.967 of 2018 on the file of IV Additional Judicial Magistrate of First Class, Warangal, is only dispensed with, while permitting them to make their appearance through counsel. However, the petitioners/Accused Nos.4, 5 and 7 shall appear before the Court below as and when their

personal appearance is so warranted, in respect of the aforesaid Calendar Case.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
