ORDER

Heard learned counsel appearing for the petitioner, learned counsel appearing for respondents 1 and 2.

The petitioner joined the service of the respondentUniversity as Assistant Lecturer in the year 1986 and later on, promoted as Lecturer/Associate Professor and Professor. While working as Professor, he was holding the office of Director, Academic and Planning and also Professor of Photography in the respondent-University. While so, when an order was passed on 01.12.2016 transferring the petitioner to the post of Professor of Photography at College of Fine Arts divesting the post of Director, Academic & Planning, the present writ petition is filed. This Court by order dated 13.12.2016 granted interim stay, as a result of which, the petitioner has been continuing till today. Seeking vacation of the said order, the respondents filed WVMP No.5132 of 2016.

During the course of hearing, it is stated that respondents 2 and 3 are not in service and as on date, they are not holding the position described in the present writ petition. It is also stated that an Executive Council is constituted for the University by G.O.Ms.No.33, dated 10.11.2017.

The issue involved in the present writ petition relates to transfer of the petitioner, which in fact is not a transfer, but

divesting him from the post of In-charge Director, Academic & Planning, while retaining the post of Professor of Photography. In view of the subsequent developments, it is for the 1st respondent-University to take into consideration all the aspects and pass appropriate orders. This Court cannot interfere with a routine administrative order of transfer.

Giving such liberty to the 1st respondent to take a decision afresh, this Writ Petition is disposed of accordingly. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 15th November, 2017 rkk
