This Criminal Petition under Section 482 of the Code of the Criminal Procedure, 1973, is filed by the petitioners/A.1 and A.2 seeking to quash the proceedings in C.C.No.872 of 2014 on the file of Judicial First Class Magistrate, Kodad, Nalgonda District.
charge sheet came to be filed against the petitioners/A.1 and A.2 for the offences punishable under Sections 120-B, 199 and 420 r/w. Section 34 of IPC. During pendency of the Criminal Petition, respondent No.2/defacto complainant has filed (i) I.A.No.3 of 2019 seeking permission to withdraw the accusations made in C.C.No.872 of 2014; and (ii) I.A.No.4 of 2019 seeking to record compromise between the petitioners/A.1 and A.2 and respondent No.2/defacto complainant and quash the proceedings in C.C.No.872 of 2014. The said Compromise Petition has been duly signed by the petitioners/A.1 and A.2 and respondent No.2/defacto complainant and their respective counsel. Along with the petition, a Joint Memo has been filed, inter alia stating that due to some misunderstandings between the parties resulted in registration of the aforesaid C.C.No.872 of 2014 against the petitioners/A.1 and A.2 and now both of them have amicably settled and
GSD, J Crl.P.No.4768 of 2019 compromised the matter amicably without any coercion from any corner and respondent No.2/defacto complainant is not interested in pursuing the matter any further. The said Joint Memo has been supported by the affidavit of respondent No.2/defacto complainant.
Today, both the parties are present before this Court and they were identified by their respective counsel. This Court, when examined, both the parties have stated that at the instance of the elders and well wishers, they have settled the matter out of the Court and respondent No.2/defacto complainant has no objection for quashing the proceedings against the petitioners/A.1 and A.2.
In the light of the compromise arrived at between the parties, the Compromise Memo filed by both the parties is recorded and I.A.Nos.3 and 4 of 2019 are ordered. Accordingly, this Criminal Petition is allowed in terms of the compromise and the proceedings in C.C.No.872 of 2014 on the file of Judicial First Class Magistrate, Kodad, Nalgonda District, against the present petitioners/A.1 and A.2 are hereby quashed.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
