P.V.S.K.Chalcraverthy, v. Union Government Of India,
HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION No. 276 of 2014 Date: 02.02.2015 Between:
P.V.S.K. Chakravarthy ... Petitioner And Union Government of India, rep., by its Secretary Ministry of Human Resources Department, Department of School Education & Literacy, New Delhi & others.
... Respondents This Court made the following:
THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION No. 276 of 2014 ORDER: (Per the Hon'ble Sri Justice Sanjay Kumar) This writ petition in public interest was filed with the following prayer:
"... to issue a writ of Mandamus or any other appropriate writ, directing the respondents to consider my representation dated 01.09.2014, and also pass appropriate orders as per law with due intimation to me, and consequently direct the respondents to conduct proper enquiry regarding the recruitment process through proceedings Rc.No.545/APKGBV/2013, dated 11.09.2013 issued by the 8th respondent."
Pre-admission notice was ordered by this Court on 17.11.2014 and the matter has undergone four adjournments thereafter. Except the 7th respondent, none of the served respondents have chosen to file a counter. As the relief sought is innocuous in nature, being a direction to consider the petitioner's representation dated 01.09.2014, we are not inclined to keep this matter pending any longer. The writ petition is accordingly disposed of directing the authority concerned to consider and pass appropriate reasoned orders in accordance with law upon the petitioner's representation dated 01.09.2014. This exercise shall be completed expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order.
Pending miscellaneous petitions, if any, shall stand closed. No
order as to costs.
