B. Ram Babu v. The State Of Telangana
THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.6141 of 2017 ORDER:
This petition is filed, by the petitioner/sole accused, under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.250 of 2016 on the file of the Station House Officer, Nacharam Police Station, Cyberabad, registered for the offences punishable under Sections 420, 406 and 408 I.P.C.
2.
The learned counsel for the petitioner submitted that the de-facto complainant falsely implicated the petitioner in this case; therefore, it is a fit case to grant pre-arrest bail to the petitioner. 3.
The learned Additional Public Prosecutor opposed the bail. 4.
It is the case of the prosecution that the petitioner was appointed as Branch Manager of the de-facto complainant company of the Hyderabad Brach in the month of July, 2015. It is the further case of the prosecution that the petitioner induced the customers, who in turn deposited the company money in his personal account to the tune of Rs.16,89,500/-. The gist of the allegations made in the complaint is that the petitioner herein cheated the de-facto complainant company by misappropriating the company money.
5.
It is not in dispute that the petitioner worked as a Branch Manager of the de-facto complainant company during the relevant period. A perusal of the record prima facie reveals that the company money was transferred to the petitioner's bank account. The record clearly reveals the role played by the petitioner in the commission of the offences.
6.
Taking into consideration the nature of the offences alleged to have been committed by the petitioner as well as the stage of investigation, this Court is of the considered view that it is not a fit case to grant pre-arrest bail to the petitioner. 7.
Accordingly, the Criminal Petition is dismissed. ________________________ T.SUNIL CHOWDARY, J Date: 24.08.2017 Ivd
