THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO.25187 of 2006 ORDER: (per SK,J) The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, the petitioner prays that the Hon'ble Court may be pleased to issue an order, direction or writ particularly one in the nature of writ of mandamus or any other appropriate writ declaring the action of the first respondent corporation in collecting the 'Aseel' tax from the members of the petitioner association as illegal, arbitrary and consequently restrain the second respondent herein from collecting the 'Aseel' tax from the members of the petitioner association and pass other order or orders in the interest of justice.'
By order dated 10.04.2007, this Court stayed the collection of the impugned 'Aseel' tax until further orders.
While so, it is now represented by Sri K.Manikanteswara Rao, learned counsel representing Sri T.S.Venkata Ramana, learned counsel for the Vijayawada Municipal Corporation, that the Corporation has taken a policy decision not to collect 'Aseel' tax from April, 2010 onwards. Learned counsel further states that in the light of this policy decision, no steps would be taken to collect 'Aseel' tax from the petitioner even for the period anterior to April, 2010.
Recording the said statement, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
