Sri Harinder Singh, learned counsel appearing on behalf of Sri Deepak Bhattacharjee, learned Senior Counsel for the appellant, would report no instructions. To some extent, he has tendered arguments for adjudication on merits as to the request made in the present appeal. It is not clear whether the appellant - plaintiff - M/s. Mega City Properties Limited is still in existence or not. In fact, the suit relates to the year 1996 and the present appeal relates to the year 1999.
