Bhogi Subrahmanyam , Bhogi v. The State Of A.P

HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRL.P.No.2490 OF 2017 ORDER:

This petition is filed under Section 439(1)(b) of Cr.P.C. to relax the conditions imposed by the Court of Sessions, Krishna Sessions Division, Machilipatnam in Crl.M.P.No.565 of 2016 in Crime No.70 of 2013 of Jaggaiahpet Police Station, now at CID, Vijayawada, whereby the Sessions Judge by order dated 23.11.2016, while enlarging the petitioner - Bhogi Subrahmanyam @ Bhogi, on bail, directed him to furnish security for Rs.2,00,000/- with two sureties. The petitioner was directed to report before different police stations on different dates at different places. But only difficulty for the petitioner is that it is impossible for the petitioner to report before different police stations at different places as directed by the Courts.

Learned Additional Public Prosecutor fairly stated that the petitioner may be directed to report before the Additional Superintendent of Police, CID, Vijayawada on first Saturday of every month, in all crimes pending before different Courts. Therefore, in view of the submission of learned Additional Public Prosecutor, the condition of reporting the accused before the Station House Officers concerned as directed by the Court below is hereby relaxed while directing the petitioner to report before the Additional Superintendent

of Police, Vijayawada on first Saturday of every month. The other conditions shall remain unaltered.

Accordingly, the criminal petition is disposed of. Pending miscellaneous petitions in the petition, if any, shall stand closed.
