The Hon'ble Sri Justice J.Sreenivas Rao Criminal Petition No.6915 of 2025 Order:

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarika Suraksha Sanhita, 2023 (for short, 'BNSS') seeking anticipatory bail to the petitioner/accused No.2 in Crime No.219 of 2025 of Ameenpur Police Station, Sangareddy District, registered for the offences punishable under Sections 85 and 80(1) r/w 3(5) of Bharatiya Nyaya Sanhitha, 2023 (for short 'BNS').

The case of prosecution in brief is that on 27.03.2025, the complainant lodged a complaint stating that his younger daughter- Vasanthi (deceased), who was married to accused No.1 in the aforesaid crime in the year 2021 and residing in Beeramguda, Hyderabad, committed suicide by hanging on 26.03.2025. He alleged that accused No.1 was unemployed and addicted to vices and used to harass the deceased for money and on the date of the incident, accused No.1 informed him

about the death of the deceased and later brought the deadbody to the house of the complainant at Ongole. Initially the crime was registered at Ongole Taluka Police Station, but later the same was transferred to Ameenpur Police Station. 3.

Heard Mr. K.Karuna Sagar, learned counsel for the petitioner/accused No.2 and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent-State. 4.

Learned counsel for the petitioner submitted that the petitioner is the mother of accused No.1 and she has not committed any offence and she was falsely implicated in this case. Learned counsel further submits that even according to the complaint, specific allegations are leveled against accused No.1 only and the petitioner is residing at Ongole whereas the deceased and accused No.1 were residing at Beeramguda, Hyderabad and the petitioner never harassed the petitioner to bring additional dowry and hence the ingredients of Sections 85 and 80(1) r/w 3(5) of BNS are not attracted against the petitior. Learned counsel further submits that the petitioner is

a housewife aged about 60 years and she is suffering from old age ailments and she is looking after the welfare of the minor child of the deceased and she has no criminal antecedents and that she be granted anticipatory bail as she is ready and willing to cooperate with the investigation and abide by the conditions as may be imposed by this Court.

On the other hand, learned Additional Public Prosecutor submitted that the petitioner committed grave offence and at the instance of petitioner and accused No.1, the deceased has committed suicide and the investigation is under progress. Therefore, if the petitioner is granted anticipatory bail at this stage, there is every chance of her influencing the witnesses and interfering with the investigation. Hence, prayed to dismiss the criminal petition.

Having considered the rival submissions made by respective parties and after perusal of the material available on record, it reveals that the petitioner is none other than the mother of accused No.1 and the petitioner is residing at

Ongole and the accused No.1 and the deceased are residing at Beeramguda, Hyderabad and the petitioner was not present at the time of alleged incident and the petitioner is aged 60 years and suffering from old age ailments and she is looking after the welfare of the minor child of the deceased. Even according to the learned Additional Public Prosecutor, accused No.1 was arrested on 03.05.2025 and 18 witnesses were already examined and the petitioner is not having any criminal antecedents. 7.

In view of the same, this Court is inclined to grant anticipatory bail to the petitioner/accused No.2, subject to the following conditions:

i. The petitioner/accused No.2 shall surrender before the Station House Officer, Ameenpur Police Station, Sangareddy District, on or before 24.06.2025, and on such surrender, the said Station House Officer shall release the petitioner/accused No.1 on bail on hers executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each.

ii. On such release, petitioner/accused No.2 shall appear before the Station House Officer, Ameenpur Police Station, on every Monday at 11:00 a.m. for a period of eight (8) weeks or till filing of the charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. After release, the petitioner/accused No.2 shall not influence the witnesses or interfere with the investigation.

iv. Petitioner/accused No.2 shall abide by the conditions stipulated under Section 482(2) of BNSS and shall cooperate with the Investigating Officer in the investigation.

Accordingly, the Criminal Petition is allowed. As a sequel, miscellaneous petitions, pending if any, stand closed.
