This writ petition is filed challenging the proceedings dated 15.03.2018, wherein and whereby the petitioner was removed from service.
Learned counsel for the petitioner submits that though preliminary enquiry conducted by the ACP, Hanamkonda shows that the sick report of the delinquent Home Guard was genuine and though the petitioner submitted explanation dated 10.03.2018 to the show cause notice dated 04.03.2018, without considering the same in proper perspective, the respondents passed the impugned order which is in violation of principles of natural justice.
Heard learned Assistant Government Pleader for Services.
Except saying that explanation submitted by the petitioner was not convincing, no reasons are assigned in the impugned order. Further, the respondents passed the impugned order only basing on the recommendations made by the Home Guards Disciplinary Committee. In view of the same, the impugned order is set aside and the respondents are directed to reconsider the issue of the petitioner and pass
orders after taking into account the preliminary report submitted by the ACP.
Accordingly, the writ petition is disposed of. No order as to costs.
