O R D E R

The complaint of the petitioner-company is that the registration authorities are

not releasing the document presented by it for registration, having numbered it as P499/2015. The document in question is stated to be a development agreement-cumgeneral power of attorney. The learned Assistant Government Pleader for Revenue, having received written instructions in the matter from the Sub-Registrar, Nallapadu, informed this Court that the reasons for keeping the subject document pending registration was that there was no description of the schedule property in the document and there was no proper assessment of the market value of the property in the context of the structures existing thereon.

Sri D. Prakash Reddy, learned senior counsel appearing for the petitionercompany, stated that the Joint Sub-Registrar, Nallapadu, addressed letter dated 02.06.2015 to the petitioner-company, wherein he informed it that an inspection would be undertaken of the property for taking measurements. In response thereto, the petitioner-company addressed reply dated 10.06.2015 requesting the registration authority to cause inspection immediately and decide the stamp duty payable on the document for the purpose of completing the registration process. Both the aforestated documents are placed on record. In the light of the aforestated facts, it is clear that the document has been kept pending registration for want of certain details which are to be gathered by the registration authorities.

As the petitioner-company is prepared to allow inspection of the premises covered by the subject document and also submit to the assessment of stamp duty payable on the document, the Sub-Registrar, Nallapadu, shall take necessary steps to complete the registration formalities and thereafter release the subject document in accordance with due procedure. This exercise shall be completed within two weeks from the date of receipt of a copy of this order. The writ petition is disposed of with the above directions. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
