THE HONOURABLE SRI JUSTICE P.NAVEEN RAO Writ Petition No.16947 of 2019 ORDER:

This writ petition is filed alleging that the Station House Officer, Prohibition and Excise Police Station, Patancheru, 3rd respondent, is unnecessarily harassing the petitioner; he is illegally detained; he is being threatened with dire consequences; compelling him to accept guilt when no crime is committed by him and the same is illegal, unconstitutional; by his actions, the right to life and liberty to the petitioner is illegally deprived. 2.

Learned counsel for the petitioner sought to contend that Crime No.15 of 2019 is registered in the Prohibition and Excise Police Station at Patancheru and shown only four persons as accused. Allegation against them is that they were carrying 200 kgs., of Dry Ganja. There was no mention made in the said crime about the involvement of the petitioner. Based on the confession statement by one of the accused wherein he has taken the name of the person as Rakesh @ Balu, the petitioner is harassed by treating a part of his name tallying with Balu remotely though he is no way concerned.

According to the learned Government Pleader, as per the instructions furnished by the Station House Officer, as per the confession statement by one of the accused A-1 and A-2, the petitioner herein is added as accused No.5 in the said crime and the investigation is pending. 4.

If that is so, it cannot be said that the petitioner is illegally harassed. If the petitioner has any grievance against inclusion of his name as an accused, he has to avail appropriate remedy as available to him in law. Since the petitioner is shown as one of the accused in pending crime and

PNR,J W.P.No16947 of 2019 investigation is pending, this Court is not inclined to entertain the writ petition and this writ petition is liable to be dismissed. 5.

Accordingly, this Writ Petition is dismissed. There shall be no order as to costs.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
